Depuy Recall

Depuy Orthopaedics, Inc. recalled all ASR Hip Replacement Systems (both the DePuy ASR XL Acetabular and DePuy ASR Hip Resurfacing Systems) sold between 2005 and 2010. DePuy obtained FDA approval to sell the ASR XL hip in the United States because its design was very similar to Depuy’s Pinnacle Metal-on-Metal hip. The DePuy ASR XL acetabular was never sold in the US. While the Pinnacle model has not been recalled, many patients have experienced severe pain with these hips, and our law firm has determined clients with these hips have viable cases against Depuy.

Depuy Hip Health Risks

Depuy metal-on-metal hips have led to increased levels of cobalt and chromium in the blood, called metallosis, which is a serious health risk. Through normal wear and tear, metal debris can be shed from the hip components, leading to tissue damage, inflammation, pain and metallosis (metal ions in the blood). A study by the National Joint Registry of England and Wales in 2010 showed 12% of ASR hips and 13% of the ASR XL hips will require revision (replacement) within 5 years of the original surgery. To date, 93,000 hips have been recalled by Depuy, meaning an estimated 11,625 people will require second surgeries by 2014.

Signs that you have a problematic Depuy hip are:

  • Pain in the leg, hip or groin
  • Hip implant dislocation
  • Inflammation / swelling
  • Limping
  • Loosening of the hip components and hardware
  • Fractures of the bone surrounding the implant
  • Heavy metals in the blood

Metallosis is a very serious medical condition that carries additional risks, including ALTR (adverse local tissue reaction) or ARMD (adverse reaction to metal debris). These conditions may cause the hip implant to become loose and cause pain, requiring a second surgery. Metal in the blood can also lead to adverse health consequences to the heart, nervous system and thyroid.

Depuy Lawsuit

Our hip claim attorneys are accepting all Depuy metal on metal hip cases. We handle these hip defect claims on an individual basis- not a class action. Currently, there is a multi-district litigation (MDL) in the United States District Court for the Northern District of Ohio, where discovery is underway. Once the discovery is complete, we will utilize this discovery to prosecute your individual claim against Depuy. On December 28, 2012, the District Court ordered the bellwether case of Faye Dorney-Madgitz to begin trial May 2013, followed by Ann McCracken on July 2013.

Depuy Hip Compensation

Our defective hip lawyers can help you obtain the compensation you may be entitled to from Depuy Orthopaedics. You may be entitled to reimbursement for all past medical expenses, all future medical expenses and attendant care, as well as pain and suffering damages. If you require a revision surgery, the pain and suffering will be quite significant, which should be reflected in any settlement or verdict you obtain.
